Punishment and fine for fishing with nets: law, requirements and rules. Fishing and fishing rules What nets are allowed to fish with

The State Duma has tightened the fine for fishing with nets in 2020. According to this standard, the use of drifter gear is prohibited. A similar measure has been taken in order to preserve valuable species of commercial fish from January 1 of this year.

In terms of penalties for poaching fishing with nets in Russia, all gear of this type is recognized. Their use inevitably entails a fine. In addition to nets, the law prohibits fishing with such devices:

  • Airguns;
  • traps;
  • trawls;
  • passive means in salmon habitats;
  • self-driving hook devices;
  • electric rods, etc.

Even for the wrong fishing rod, you can get a fine. These include gear with more than 10 hooks per angler. Also poaching is considered to be the use of oil-cake traps and harvesters, fishing with diving, huts on ice. You can not jam the fish, block its movement, illegal fishing and when using trolling.

In addition to gear, restrictions apply to some water bodies. Generally, fishing is prohibited at the following sites:

  • with limited access;
  • specially protected;
  • important in the field of security and national defense.

An important point is that the areas where fishing is allowed are determined individually for the regions of the Russian Federation.

What is the fine for networks in 2020

If the law is violated, poachers face quite impressive penalties. Such severity of punishment is designed to prevent violators from destroying valuable fish resources during the spawning period. The penalty for catching fish with nets is imposed in different size, which is due to a number of concomitant factors. As a rule, if a poacher is caught fishing in a prohibited reservoir, he shines:

  • a fine in the amount of 2-5 thousand rubles;
  • confiscation of gear;
  • removal of the watercraft;
  • additional penalties separately for some fish species depending on their size.

When summing up the total fine, how much will be for all the points described, the output is an impressive amount, reaching up to several hundred thousand rubles. For a female with eggs, the poacher will have to pay double the cost of the fine. If the fish did not die during fishing, then half of the initial penalty amount is collected for each individual.

If the law on fishing is violated, the poacher will inevitably have to fork out a round sum. And if an official is caught for illegal fishing, then the penalty for net fishing will be much more impressive. If the volume of production is unreasonably large, then the matter may reach criminal liability.

Who can use the networks

Penalties for networks in 2020 are impressive, but they are not assigned to everyone. Such equipment can be used by citizens with special permission. But even with permission to use fishing tackle allowed only in some subjects of the Russian Federation, such as the Far East, Siberia and the northern regions. But in Mordovia, Tatarstan and other republics, such fishing is punishable by a fine, there is no permit for it.

Upon receipt of a license from the Federal Agency for Fishery, all networks are marked and taken into account. When checking, the data must match, otherwise a fine will be assigned. The license is issued for a specific citizen and cannot be extended to third parties. Otherwise, the violator may be subject to criminal, civil or administrative punishment.

How and where to get a license

The issuance of licenses is carried out for a fee in the regional offices of the Federal Agency for Fisheries. The document is in the prescribed form. Payment is made not only for the license itself, but also for catching specific fish species (salmon, etc.).

You can also obtain such a permit from an organization (or from an individual entrepreneur) when drawing up an agreement for a fish breeding site for fishing in a supervised reservoir.

  • Nominal fishing licenses are strictly reporting forms and are issued to specific citizens without extending to other people.
  • The license indicates the personal data of the fisherman, his passport metrics, the validity of the document.
  • The license has a series and number, the date when the document was issued is written.
  • It indicates where fishing is allowed, what kind of fish and how much can be caught.

Caught fish cannot be used by the fisherman for sale. In case of violation of the restrictions stipulated by the license, the fisherman will have to bear the appropriate responsibility.

Is it possible to catch with a casting net

Casting nets in the Russian Federation began to be used not so long ago, although in the southern regions of the country, fishermen have been using similar gear (it was called a cape) for many years. This network is also called a parachute. It is believed that the use of such gear allows you to get good catch, but this requires some skills and some training.

In general, fishing with casting nets is not forbidden, but only in waters where fishing is allowed. But here it is important to observe one condition - the diameter of the parachute should be no more than 2 m. To avoid a fine, before using such gear, you should familiarize yourself with the rules of legal fishing in your area. Even if such a network is prohibited, and she really wants to go fishing, you can always get permission.

Can you fish with nets? It is possible if the owner of such equipment has the appropriate permission.

What else to consider when using networks:

  1. The length of all settings. The numbers vary depending on the region. The average figure is from 30 meters to 80.
  2. The minimum cell size. The average value is 50 mm, the figures vary by region.
  3. When fishing is allowed. Depend on the region.
  4. Prohibitions in special areas of the reservoir.
  5. The number of heads allowed to be caught.
  6. Permissible minimum sizes of each fish.
  7. What is the fine for fishing with nets in 2018 and for other violations.

More information about the restrictions can be found on the website of the Fisheries Inspectorate of the area for fishing in which the citizen will issue a permit.

Every fisherman knows that any fishing is prohibited during the spawning period. The ban period varies by region.

Prohibition of the Moscow region:

  • at the cooling reservoirs of the Shaturskaya and Elektrogorskaya power plants, it is forbidden to catch fish from March 22 to June 01;
  • other areas: prohibited from 01 April to 10 June.

For violation of the ban, you will have to pay a fine for fishing during spawning, as well as give gear and a boat to the state. If the volume of prey caught is large, then catching fish in the ban will be punished under a criminal article.

Important: there are weight restrictions! In each region they are different, depending on the breed and value of the fish. Average value: approximately 5 kg. for one person.

For violation of the law on the use of aquatic biological resources, the following penalties and fines are provided:

  1. For violation of the rules for catching fish and other rules for the implementation of fishing (CAO Art. 8.37 part 2). Punishment: a fine equal to 2000-5000 rubles. for citizens, confiscation of the vessel and fishing devices.
  2. For catching fish during spawning. Punishment: fine - up to 300,000 rubles.
  3. For catching carp, carp or pike during spawning. Punishment: a fine of 250 rubles. for each individual. For bream - 25 rubles, for crayfish - 42 rubles. If the caught individual is a female, then the amount of the fine increases by 2 times. For each individual of sturgeon breeds - 100% of the amount of the fine additionally (for fishing), for each individual of whitefish or salmon - 200% of the amount of the fine additionally.
  4. For illegal fishing through the use of prohibited fishing gear, causing damage on a large scale, during (and in places) spawning, in prohibited places for fishing (Article 256 of the Criminal Code of the Russian Federation). Punishment: a fine of 100,000-300,000 rubles. for citizens, or arrest for 6 months.
  5. For the destruction / damage of special signs that define the boundaries of specially protected objects, protected zones of water bodies, etc. Punishment: a fine of 300-500 rubles. for citizens.
  6. For fishing without a license (if necessary) or in violation of the conditions stipulated by the license (CAO Art. 7.11). Punishment: a fine equal to 500-1000 rubles. for citizens.
  7. For destruction rare species fish (from the Red Book). Punishment: a fine equal to 1000-2000 rubles. for citizens, confiscation of the catch itself and fishing gear.
  8. For violation of the rules of resettlement, acclimatization or hybridization of objects of aquatic biological resources (CAO Art. 8.36). Punishment: a fine equal to 1000-1500 rubles. for citizens.
  9. For violation of the rules of navigation for ships. Punishment: a fine equal to 500-1000 rubles. or deprivation of the right to operate a vessel up to 1 year.
  10. For parking a car by a pond. Punishment: a fine equal to 3500-4000 rubles. (Note: from the water's edge to the car must be at least 200 m).
  11. For violation of the rules of water use in the implementation of fishing (CAO Art. 8.14 part 2). Punishment: a fine equal to 1500-2000 rubles. for citizens.

To prevent this, the law provided for a fine for fishing in violation of the norms and permissible scales. At the same time, fishing with nets is allowed only in some regions of Russia. These include Siberia, the Far East, as well as the northern regions of the country.
At the same time, enterprises engaged in fishing must have a license obtained by the fishery of the Russian Federation.

To obtain such permission, specialists keep records and mark each network used, applying the owner's data.
The document granting the right to fish cannot be transferred to third parties.

Accordingly, punishment may be administrative, criminal or civil.

If the law is violated not by one person, but by a group of persons, then the punishment will be more severe, they may even be imprisoned for several years.

Who can not be hunted A fine is imposed for hunting certain types of herons, the Far Eastern stork, the Amur tiger, the spoonbill, the clatter.

During a certain period, you can not hunt elk, catch salmon.

Ordinary citizens are not far behind: they actively use electric fishing rods, nets, and explosives.

Residents of villages located near military units are especially zealous.

The government proposes to amend the Administrative Code and increase fines for illegal fishing by 5-6 times.

If the law is passed, violators will be fined 1955-2975 UAH, not only for fishing, but also for a net or electric fishing rod found in a backpack, car, boat.

Where can you fish with a net

The state cares about the conservation of natural resources, therefore unauthorized uncontrolled fishing is prohibited. Persons wishing to engage in this business must comply with the rules of fishing. The main issues of catching fish are regulated by the Federal Law "On Fishing and the Conservation of Aquatic Biological Resources" dated December 20, 2004 N 166-FZ.

The specified law provides features fishing in Russia. The document establishes several types of fishing, as well as the nuances of their implementation. These include:

  • industrial;
  • coastal;
  • for research and control purposes;
  • for educational, cultural and educational purposes;
  • for the purposes of fish farming;
  • amateur, sports

Regular fishing falls under the concept of recreational fishing. The law allows citizens to exercise it free of charge and freely on water bodies for public use. Fishing on private reservoirs is possible only with the consent of their owners for a fee agreed with them.

The rules for fishing are also established by the laws of the constituent entities of the Russian Federation. At the same time, in each subject they may differ in relation to prohibitions and restrictions on places and methods of fishing, the amount of permitted catch, and the types of fish caught. The issue of using nets by fishermen is also solved in different ways.

However, some rules are followed in all regions of the country. Such prohibitions include fishing during the spawning period, using poisonous substances, electric fishing rods, traps, and nets. All these restrictions are aimed at preserving the country's aquatic biological resources.

At the same time, some of these prohibitions cannot be lifted, while others are removed after the fisher receives a special permit. So, a license to fish with nets allows fishing enthusiasts to legally do what they love. True, residents of not all regions can obtain such permission.

Residents of Siberia, the Far East, and the North can count on fishing with a net if they have the appropriate license. Otherwise, fishing with nets will be considered illegal and punishable by a fine.

Fishing license - what permission is needed?

In order to fish with a net or catch a rare species of fish, you will have to get nominal resolution. This document is issued on the form of the established form for a fee. You will have to pay not only for the permit itself, but also for catching certain types of fish, such as salmon.

Permits can only be obtained in the manner prescribed by law. Permits are granted by:

  1. Rosrybolovstvo and its subdivisions in the field. These authorities issue documents for fishing in public waters.
  2. Individual entrepreneurs or organizations when concluding contracts for the provision of a plot (fish-breeding) for fishing in their reservoir.

Personal permission to fish with a net refers to strict reporting forms. It is issued to a specific angler and cannot be transferred or sold to other persons. This is expressly stated in the license form itself. This document must also contain information about the name of the fisherman, his passport data, the validity period of the permit.

The document has a specific number, series and date of issue. In addition, certain requirements are imposed on the networks themselves. They must be marked, i.e. contain information about their owner and the availability of a permit to catch bioresources. The regions may also provide for requirements for the size of networks, their cells, and places of use.

Useful information "Sample application for parole under article 79 of the Criminal Code of the Russian Federation and filing features."

What is indicated in the nominal license

In addition to information about the owner of the permit, it specifies certain restrictions on the catch of biological resources. In particular, the document provides for where you can fish, how much and what kind of fish to catch. The angler will be liable for violation of the restrictions stipulated by the permit.

It is important to remember that this document is provided for amateur fishermen. This means that they fish solely to satisfy their needs or interests. Caught fish they have the right to both release and take with them. But they cannot use their catch for sale.

The new law clearly defined the right of an amateur fisherman to fish for free in all water bodies. Russian Federation common use. There are also some restrictions.

They concern fourteen species of fish, listed by name. For their fishing, a fishing license is provided, which appears under the name "registered permit".

A pensioner from the Vileyka district paid 47 million for catching fish with nets

A heavy catch - 60 individuals, including 38 pike perch - was frozen and handed over by inspectors to the trading network for sale.
The caught fish was valued at 47 million Belarusian rubles. By the way, the poacher has already repaid this amount.

However, the pensioner is facing another punishment, most likely, it will be a large fine in a criminal case. Now it turns out where the man bought the nets, since the sale of nets to amateur fishermen in the Republic of Belarus is prohibited.

What is a fishing card and how does it work

In addition to registered permits, fishing enthusiasts may be issued a fishing card. It is provided to persons of non-retirement age for fishing in any water bodies of the country.

The card can be issued for a period of one month to one year. It indicates the name of its owner, his data, as well as information about the authority that issued the document. True, it will be impossible to catch fish of valuable species according to this document.

The document is also registered, so it is forbidden to transfer it to other fishermen. A map is provided, as is a permit for a fee. It may differ in different regions. In addition, the fee may vary, so before purchasing a document, you should clarify its price in advance.

Unity with nature. How wonderful it is to settle down on the bank of the river, cast a fishing rod and rest your body and soul. However, legislative regulation has reached this area. All the new fishing legislation in 2018, which requires the permission of the angler and much more useful information you will find in this article.

Improving the legislative framework in the region effective management For the past few years, the fishery complex of the Russian Federation has received special attention. Unfortunately, such a specialized attitude is explained not only by the need to preserve the integrity and productivity of aquatic ecosystems, but its main reason is the introduction of the bill “On recreational fishing” to the State Duma at the end of 2012.

Currently, the bill is still under consideration. The issue of paying for amateur fishing, which was regulated by the December 2010 amendments to the law on fishing, was subjected to mass discussion and censure.

The public analysis of the new fishing law, which took place on the Internet on the official website of the Government of the Russian Federation, “smoothed out” sharp corners and made adjustments to more than 60 norms. This experience of crowdsourcing (involving ordinary people in the direct development of a regulatory document) turned out to be successful, and soon we will have new fishing rules in 2018 that meet public requirements.

However, now amateur fishing in 2018 is regulated by the current legislation, the so-called law on fishing (fishing) 2018, namely the Federal Law No. 166 “On fishing and the conservation of aquatic biological resources”. The main norms and prohibitions of the fishing bill will be considered in our article.

Recreational fishing is an activity for the extraction (catch) of recreational fishing objects, stocking objects, carried out by individuals for personal consumption and (or) for recreational purposes (tourism, recreation, sports), including during physical culture and sports events official character.

New recreational fishing rules 2018: where is it allowed to fish?

Recreational fishing is allowed on water bodies:

  • Common use;
  • Specially protected natural territories, taking into account the established procedure for a particular territory;
  • Owned by legal entities or individuals, as well as individual entrepreneurs.

Amateur fishing is carried out freely and free of charge. Paid fishing is provided only for:

  • on water objects of recreational fishing farms (use of paid services in the field of amateur fishing);
  • according to the nominal permissions of the fisherman when catching valuable and especially valuable species of fish, as well as using nets.

Fishing restrictions, in addition to those listed in current legislation and applicable to recreational fishing, include a ban on:

  • The use of explosives and chemical substances, electric current (electric fishing rods);
  • Use of networks (subject to exceptions).

The use of nets is allowed only for organizations and individual entrepreneurs that have a permit for the extraction of aquatic biological resources, and individuals who have personalized fisherman's permits.

Who has the right to organize recreational fishing

  1. State bodies represented by territorial bodies of federal executive bodies in the field of fisheries (they issue registered permits);
  2. Legal entities and individual entrepreneurs in the implementation of recreational fishing under a contract for the provision of paid services.

Recreational fishing industry is the activity of stocking with fish, fishery reclamation, the creation of the necessary infrastructure, as well as other activities within the framework of the law, carried out to provide physical. persons of reimbursable services in terms of amateur fishing in specially designated fishing areas for these purposes.

The maximum allowable area of such sites is set at the level of a single subject of the Russian Federation, and an agreement on the provision of a fishing site is concluded based on the results of bidding for a period of up to 25 years.

Share of water bodies for free and free fishing within the boundaries of each subject of the Russian Federation should be at least 90% of the water fund.

Angler's license

The personal permission of the angler is a strict reporting document that has a series and number. It indicates: full name, passport data, date of issue and validity period, information about the authority that issued the permit, permitted fishing gear, dates and places.

Gives the right to catch the following aquatic biological resources:

  1. chum salmon;
  2. pink salmon;
  3. sima;
  4. coho salmon;
  5. red salmon;
  6. chinook;
  7. mykizha;
  8. Atlantic salmon;
  9. nelma;
  10. muksun;
  11. taimen;
  12. king crab;
  13. prickly crab;
  14. blue crab.

To whom is a permit issued:

  • Individuals for amateur fishing of the above types of biological resources outside the fishing grounds;
  • Individuals for amateur fishing using nets.

Who issues the permit:

  • Federal executive authority in the field of fisheries;
  • A legal entity or individual entrepreneur who has entered into an agreement on the provision of a fishing plot. (They, in turn, are provided with personalized permit forms by the federal agency upon request).

The state duty for issuing a personalized permit for a fisherman will be 200 rubles. In addition, the 2018 fisheries law will also establish a fee rate for each object of aquatic biological resources (from 35 to 200 rubles per item), as well as introduce daily allowance extraction of recreational fishing objects for individuals within one calendar day.

At the same time, the rules of the law on recreational fishing in 2018 allow the return of caught aquatic biological resources to their habitat, provided that they physical state this allows.

The daily catch rates for recreational fishing objects do not apply to recreational fishermen using registered angler permits.

Responsibility for catching fish with a net without permission

For non-compliance with the rules in smaller amounts, citizens can be fined 2000 - 5000 rubles. These fines for illegal fishing are provided for in Article 8.37 of the Code of Administrative Offenses of the Russian Federation. The amount seems to be small, but if we add to this the confiscation of the ship, gear, caught prey, we get quite a decent figure.

Violators of the legislation in the field of protection of water bodies and their inhabitants face the imposition of administrative and sometimes criminal penalties. Special authorities monitor the observance of the rules by fishermen. It is clear that they are not able to identify all cases of committed offenses. But, if the poacher is caught, he will have to answer for his illegal actions.

The Code of Administrative Offenses provides for a fine for violating fishing rules by fishermen. Its size for citizens-violators is from 2000 to 5000 rubles. In addition, the poacher will be confiscated the watercraft and all the equipment for fishing. The same code contains a rule on liability in the form of a fine for not having a license.

If illegal fishing was carried out with the help of prohibited devices, then the responsibility will already be criminal. Recall that networks are not allowed everywhere, and their free use is prohibited.

When using them, if the catch has reached a large size, and also when fishing was carried out in a prohibited place, you can get a fine of up to 300 thousand rubles. or arrest for up to six months.

If, when fishing with a net, fish species listed in the Red Book were destroyed, then you will have to return the entire catch, lose all the tools for fishing, and pay a fine. For especially serious violations, you can even pay with personal freedom. The regions may provide for special requirements for anglers and liability for their violation.

Liability is carried out in the following way. First, the inspector identifies a violation, then a protocol is drawn up. Based on the established fact, a case is initiated, and the perpetrator is held accountable. If an amateur angler does not agree with the adopted acts, he has the right to challenge them through the courts.

Fishing Online

And now, if all this is to be said much more simply and more clearly, we have the following: If someone is caught (I hope not you) for catching fish with nets for spawning or in places prohibited for fishing, then: - you must pay a fine (from 2000 to 5000).

Read more about penalties for fishing.
- your boat will be confiscated; - nets will be confiscated from you (if the fact of catching on them is proved); -you will still have to pay for each head (i.e. fish) caught.

Based on this, the amount establishing a fine for catching fish with nets can reach all 500,000 rubles.

Net fishing law

The main document regulating fishing in our country is the Federal Law “On Fishing and Conservation of Aquatic Biological Resources”. There are registered general rules, but there are no uniform rules for all regions. Each region sets its own limits on the size of fish, on its quantity, on the use of gear, etc.

There are general restrictions: fishing with nets is possible only with special permission. It is forbidden to do this during spawning, in spawning places, on the ways to it.

So, for example, the table of fines of the Rybnadzor in 2018 states that a citizen can pay from 300,000 to 500 in money for the illegal extraction of aquatic biological resources on a large scale.

000 rubles (Article 256 of the Criminal Code of the Russian Federation). For officials, the amounts and terms are much larger.

You can learn more about prohibited fishing from the relevant laws. For example, from Federal Law No. 166 (note “On fishing ...”). According to this law, you can fish for free and freely if you do it on water bodies for which there is no special / mode of use. But even under these conditions, you may be affected by restrictions approved by law.

The main list of restrictions is regulated federal agency- Rosrybolovstvo.

These include…

  1. Prohibition of fishing in certain areas and prohibition of catching certain types of fish.
  2. A certain weight and size of fish caught.
  3. Number, type, size and design of fishing devices and methods of fishing.
  4. Permitted/prohibited periods for fishing.
  5. Sizes, number and types of vessels for fishing.
  6. Catch volume per 1 individual or 1 vessel.

…And other restrictions.

As for the permitted specific places for fishing in Russia, they are determined by each region independently.

The places prohibited everywhere are the following ...

Of course, for a real fisherman there are no such “fishy” nuances that he would not know about. But given that our aquatic bioresources are depleted from year to year, we risk one day simply not finding fish in our rivers and lakes. Therefore, the rules for law-abiding fishermen will not be superfluous for anyone.

Note: specific places for legal fishing and clear deadlines for bans on it should be found directly in the region where they are established (they are different everywhere!).

Where can you fish?

Otherwise, you can easily break the law.

Penalty for spawning fishing Before we talk about the tools and methods of illegal fishing, we should highlight some points of fishing by season.
Many probably know that there is a spring ban on fishing. The nuance is that the timing of spring spawning of fish is determined at the local level by local legislation.

In general, the impressions are only positive!

The Fishing Law and the new Fishing Regulations 2018 came into force in June 2017. It was adopted and approved by the Federation Council in 2004.

The law consists of 8 chapters and 57 articles that describe the rules of fishing on the territory of the Russian Federation.

The first chapter consists of 9 articles. It regulates the main provisions of the law on fishing and on the protection of water resources.

Fishing rules in 2018: where, how and what you can fish

And how many people know that, in accordance with paragraph 125 of the Rules, “in recreational fishing, it is allowed to catch fish that have not reached the fishing measure given in Appendix 2, at a rate of not more than 20% of the number of fish caught of each of the species for which the fishing measure is established”? What is this measure, for which types of fish is it established, how is it determined and what is it, for example, for chub or ide?

What you need to know The amateur fisherman needs to be clear about what is meant by the term "recreational fishing".

The Government of the Russian Federation has adopted a bill that provides for the introduction of new rules for lovers of fishing this year. Restrictions are expected in the number and name of fish allowed for fishing, and increase in monetary sanctions for violations.

The new Federal Law No. "On recreational fishing and on amendments to certain legislative acts of the Russian Federation" was adopted in December last year. However, it will come into force only from the beginning of 2020.

The new fishing rules will limit fishing enthusiasts in a quantitative and qualitative sense, taking into account the type and size of fish.

ATTENTION! Each region of the state has its own indicators.

Fishing rules from this year

The adopted amendments provide for the following changes:

  • restrictions on some water bodies where products are caught for commercial purposes have been determined;
  • a ban on the use of chemicals and explosives;
  • free use of reservoirs. Liquidation of territories providing services for money within two years. the exceptions are reservoirs located in special territories;
  • setting the allowable catch rate;
  • ban on the use of networks (does not apply to areas Far North, Far East and Siberia).

Physical culture and sports areas will not be limited in the amount of caught products by the state.

Status of the normative act and its main provisions

The fully adopted changes will be effective in 2020. This year, only paragraph 8, article 16 of the Federal Law No. is guided. Therefore, taxes on fishing in Russia still exist.

In each region of the country, the rules differ among themselves due to different environmental conditions.

What restrictions are set

In accordance with the new law on fisheries, the use of water bodies is allowed without restrictions and financial contributions to the budget.

However, according to Article 6 of the Federal Law No., there are still some restrictions on such objects:

  • with increased security;
  • on lands important for the defense and security of the state;
  • with limited access for ordinary residents of the country.

Also in the law on fishing, such prohibitions are displayed on:

  • networks;
  • places of rest for citizens;
  • the use of chemicals and electricity;
  • underwater fishing;
  • use of scuba gear and other similar devices.

During the competition, the catch rate will be approved in advance.

The Federal Agency for Fisheries introduced the following points for fishing enthusiasts:

  • determination of the size and weight of captured aquatic animals;
  • temporary restrictions;
  • requirements for fishing gear and means of movement on the reservoir.

Note! Fishing places in each region of Russia are marked with their own.

Fish catch rate in Russia in 2020

The daily allowable catch rate per person is five kg per day, unless the weight of one piece is greater.

If the fishing was delayed for several days, then their number is multiplied by this rate.

The quantitative standardized indicator reaches 30 pcs. per day per citizen. This applies to the following fish:

  • zander and carp;
  • grass carp and catfish;
  • silver carp.

The standard catch rate for animal species varies by region.

How, where and what not to catch

The places where the fishing law categorically does not allow you to stay include:

  • spawning farms;
  • in protected areas;
  • fish farms;
  • everywhere during the release of young fish;
  • near bridges, dams;
  • in the area of the fairway;
  • in nurseries.

By its decree, the government prohibits the use of such fishing gear:

  • traps;
  • pneumatic weapons;
  • bottom nets;
  • networks;
  • traps;
  • electric fishing rods;
  • prisons;
  • passive weapons;
  • spinning rods (with 10 or more hooks);
  • homemade devices;
  • pricking agents.

The following methods are also strictly limited:

  • jamming;
  • creating barriers;
  • installation of a hut on the ice;
  • prohibition of backlighting.

The method of lowering the reservoir is strictly prohibited.

Valid values

If, when catching an aquatic animal, its length did not reach the dimensions indicated in the table, then it must be released back into the reservoir.

Length is measured between two end points - snout and tail.

What about underwater fishing

Deputies of the lower chamber by their decree established a ban on underwater fishing using scuba gear or echo sounder. Such measures are aimed at saving large fish and will limit the volume of their catch.

Diving without special means allowed.

Penalties and sanctions in case of violation of established rules

Fines are provided for non-compliance with the adopted fishing law. The liability varies depending on the type of violation. The approved sizes are:

  • fishing during spawning - 300 thousand rubles;
  • use of a prohibited weapon and stay in unauthorized places - from 100,000 to 300,000 rubles. for citizens. A measure of imprisonment up to 6 months may be applied;
  • violation of the rules of navigation for water transport - 300–500 rubles;
  • car parking near a reservoir - 3.5–4 thousand rubles;
  • catching a certain type of fish - up to 250 rubles. (for each individual), for sturgeon and salmon breeds, sanctions are doubled;
  • for damage to special signs placed by departments - 300-500 rubles.

For non-compliance with the accepted norms of water use, monetary penalties reach 1500–2000 rubles.

Innovations 2020

The new adopted law on fishing, which in 2013 aroused violent indignation among the inhabitants of the country, will nevertheless come into force from the beginning of next year.

It will be allowed to fish for free, not counting the water places of management.

Such a law will significantly limit the list of fishing tools and methods, narrow the list of fish species. According to the deputies, this will help save the country's natural resources.

Going fishing, few people think about the legislation, prohibitions and fines that threaten the misuse of the country's water resources. But there are such restrictions, so before packing things, you should familiarize yourself with the list of gear allowed for use, and whether there are spawning ban. It is better to find out the information in advance in order to avoid an unpleasant meeting with fish inspectors.

Fishing is illegal: restrictions and liability

Any law-abiding fisherman knows that spawning is not a sentence, and fish can only be caught by strictly defined methods. So, it is not allowed to catch with the following fishing gear:

  • nets, fences and other traps - because this method is poaching and is prohibited all year round;
  • float rod with three or more hooks;
  • spinning;
  • fishing from a motorboat.

But there are still ways to take your soul off fishing and it is possible to fish like this:

  • from the shore;
  • within the city, village, settlement and so on;
  • on a fishing rod with one hook, but not more than 3 kg at a time;
  • on permitted commercial waters.

Note! Illegal fishing is punishable by the Federal Law "On Fishing and Conservation of Aquatic Biological Resources", adopted by the State Duma on November 26, 2004. The constituent entities of the Russian Federation took part in the coordination of the law, according to which they themselves determine the timing and rules for catching fish, based on the climate and the presence of fish species in a particular region.

For example, in Moscow, the Moscow Region and the Moscow Region, the restriction on fish catch in the spring and summer period is valid from April 10 to June 10, at which time fishing is allowed only with a line from the shore and the fish inspector can easily fine violators. In other regions, the climate is different, respectively, the time frame is also different, but on average from the first half of March to mid-July.

Penalty for fishing in the ban 2018

There may be several penalty cases depending on the types of fishing for which the violator was caught.

Important! The Criminal Code of the Russian Federation provides for the maximum penalty - imprisonment. This is indicated in article 256 of the code. The table of Rybnadzor fines 2018 is quite extensive, but only a few of them are considered here. How much will you have to pay a fine for violation of fishing rules?

  1. The fine for fishing during spawning in 2018 can be up to 300,000 rubles.
  2. The fine for fishing nets 2018 varies from 100,000 to 300,000 rubles or restriction of freedom for up to 6 months.
  3. The fine for poaching fish in 2018 in the new version of the law is from 200,000 to 500,000 rubles or restriction of freedom up to 2 years.
  4. The fine for violating the rules of catching and fishing is from 2,000 to 5,000 rubles and the confiscation of a swimming facility along with gear.
  5. For catching carp or pike during spawning, you will have to fork out up to 200 rubles per individual, and if the fish turned out to be a female, then the amount of the fine is doubled.
  6. The fine for catching rare species ranges from 1,000 to 2,000 rubles with confiscation of fishing gear.

Fines for drift-net fishing have recently increased by 8 percent. Unofficially, the fish guard says that if there are three hooks on a wobbler, then it can be considered as one, but you should not take risks, because inaccuracies and loopholes in the law may not play in the direction of an unlucky fisherman.

Nets are prohibited gear in almost all regions of the country. The netting penalty is one of the most severe. They are allowed to catch only enterprises that have a license to this type with Anastasia. On the nets, employees of the fishing agency put the data of the enterprise to which they belong. Whether such gear is allowed in a particular region - you need to check separately with the Federal Fisheries Agency.

What is a personal permit and an angler's card

But not everything is as sad as it seems, and avid fishermen have the opportunity to do what they love even during the ban. There are two documents that allow you to get around the ban, and this was made possible thanks to changes in fishing rules in 2018. Such documents are, for example:

  1. Name resolution. The document is issued to a specific person, its transfer to third parties is prohibited. Thanks to the permit, it is possible to catch rare fish or use nets. It costs only some 200 rubles, but for each fish you will have to pay from 35 to 200 rubles additionally, the amount depends on the breed and the rarity of the fish caught. The permit is issued by the federal fishing authority or by the owner of a private area where fish farming is practiced.
  2. Angler's card. All citizens of non-retirement age have the right to issue a fisherman's card, which allows fishing throughout the state. The advantage over a nominal permit is the ability to catch rare and valuable breeds. The catch is not for sale, it can only be used for personal use. Rosrybolovstvo issues cards for a fee. An annual card costs 500 rubles, and a monthly card costs 100 rubles.

Note! It should be understood that bans and fines are not a means to get more money out of a fisherman's pocket. This is a desire to protect the ecosystem, to protect rare fish species from extinction, in order to leave at least something good for our descendants.

How are fines for violation of fishing rules issued?

So, what should be remembered if there was an unpleasant meeting with a fish inspector? First, he presents documents certifying his position. Then the procedure for filing a protocol for an offense begins. At this stage, the presumption of innocence still works, that is, the inspector describes a violation of the law, but this violation still needs to be proven.

On the form of the protocol, a place is allocated where you can independently describe the situation, how exactly the situation looks through the eyes of the angler. There is enough space, but if necessary, it is possible to ask the inspector for an additional sheet. Honesty, openness and admission of guilt, if any, will become extenuating circumstances in court, where the protocol, together with the collected materials, is subsequently sent.

On a note. If fishing was carried out with tackle, then they are subject to mandatory confiscation.

The inspector describes in detail in a separate form their name, quantity, external features and degree of deterioration. When innocence is proven in court, all confiscated property will be returned to in full force in accordance with the description. Otherwise, you will have to pay a rather big fine and say goodbye to fishing gear forever. The fine for catching fish with nets in 2018 is one of the most severe.

Important! Lawyers advise that you must attend court sessions and protect your interests, otherwise the court can easily make a decision not in favor of the fisherman and fine you on all counts.

Changes in the legislative framework

The legal framework will soon undergo significant changes. The federal fisheries law changed back in 2016 but will come into effect by the end of 2018. Here are a few fixes:

  1. Created innovative fish catch quota for investment purposes. It is planned that this step will encourage entrepreneurs to create new fish processing companies. Against this background, it is also planned to develop the fishing fleet of the Russian Federation and build modern ships. The shares will be distributed by the executive body that controls the sphere of fisheries and the conservation of natural resources. It is planned to conclude about 7,000 contracts for a period of 15 years with the owners of investment objects, which will meet the requirements of a specially created commission. The procedure will be supervised by the Federal Agency for Fisheries.
  2. Will be updated and coastal fishing rules. Freezing of fish directly on the vessel and reloading of the catch will be prohibited. In addition, it was previously allowed to catch not only fish that fell under the concept of “total allowable catch”, but also other biological organisms that did not fall under the TAC, but the new law prohibited the capture of everything except fish that complied with the TAC. Violation is punishable by forfeiture of fishing rights.
  3. Decree No. 486 required of ships operating in the Pacific Northwest, provide the border service with the catch and products made from it. Checkpoints were set up at which ships were subjected to mandatory checks. Thanks to the abolition of this norm, anglers will be able to save a large number of time.
  4. Order of the Ministry of Agriculture No. 294, issued in 2016, defines technical means of control of fishing vessels. Now the vessel should be equipped with Inmarsat and Gonets satellite communications equipment equipped with an automatic identification system. If the ship does not go further than 75 degrees south and north latitude, and has a draft of up to 300 tons, then the outfitting should take place before June 1, 2018. But the experts of the monitoring center took the initiative to postpone this replacement until the beginning of 2019.
  5. Decree of the Government of the Russian Federation No. 764 ratifies list of species caught, in relation to which investment shares are opened.

Legislation is constantly changing and improving, and avid fishermen should periodically study it in order to avoid unpleasant meetings with fish inspectors.

Conclusion

The ban on fishing should not be ignored in the ban, because it is at this time that the future population of fish and other inhabitants of water bodies is laid. If you interfere with the spawning of fish, then in a few years it is possible to completely lose some species of fish, and you can forget about fishing. Therefore, the fine for fishing in the 2018 ban is not introduced in vain and, when going fishing, you need to ask if there are given time fishing restrictions. This information is widely covered by periodicals.

The State Duma recently introduced a new law prohibiting driftnet fishing. Violators are subject to a fine for catching fish with nets in 2020. This resolution is aimed at preserving rare fish species during the spawning period.

On January 1, the new law began to work, but it did not stop all poachers. After all, fishing with such gear is extremely effective, and the scale of production is colossal. It was to preserve spawning grounds in Russia that such a law was adopted.

It is forbidden to fish not only with nets, fishing is considered illegal if it violates the following rules:

  1. Spawning ban. During the spawning period, the catch is allowed only on a fishing rod (bottom or float) with 1-2 hooks.
  2. Prohibited places. Each region has its own, so you need to clarify. In addition, it is forbidden to fish in special spawning areas or winter quarters.
  3. Norm per day. In Russian regions, the volume of catch is 5-10 kg per fisherman. In some areas, this value varies slightly.
  4. Dimensions. Their sizes of fish individuals are set for each region. In addition to the general penalty, you will have to pay for each prohibited fish.

Fishing with the help of nets is allowed only in a few Russian regions, such as Siberia, northern or Far Eastern regions. Moreover, those enterprises that carry out fishing activities there must obtain a special license. But in Mordovia it is forbidden to use any networks, as in many other regions. In addition to nets, any traps, dredging, trawling or straining fishing gear are considered prohibited. Also considered illegal are traps, pneumatic and firearms, trap hooks, tackle that affects fish with electric current, chemical or toxic substances, and explosions. In case of violation of these requirements, a fine is imposed for catching fish with nets or other prohibited gear.

Is it possible to catch with a casting net

Recently, a variant of fishing with a casting net, which is also called a parachute or cape, has appeared in Russia. This is one of the most effective fishing tools today, the main thing is to cast correctly. The law allows the use of a casting net in fishing. With it, if you have certain skills, you can fish from the shore or from a boat.

Some fishermen do not intentionally use a casting net because they believe it is a poaching tool. But that's not the case at all. Yes, in a few regions this fishing option is banned, but in most regions the casting net is allowed, provided that its diameter does not exceed 2 meters.

To use a parachute net in fishing, you need to pay a license to the fishery supervision, then a catch quota will not be required. Fishermen consider the casting net as an attribute of sport fishing or recreational fishing. In order not to accidentally break the law, it is better to fish with such equipment on paid lakes, and release small fish back into the reservoir.

What is the fine for fishing nets in 2020

For illegal fishing, violators are supposed to collect a fine, and quite an impressive amount. The law of the Russian Federation spells out how much is due for certain violations of fishing. According to the legislation, fines for networks in 2020 include:

  • Monetary recovery of 2-5 thousand rubles.
  • Network confiscation.
  • Removal of the boat.
  • Cash payments for all fish caught.

When calculating the total amounts for all items, the punishment will be quite impressive amounts. But if the caught fish did not die, then a fine of 50% will be charged for each fish caught. And for a female with caviar caught in the net, you will have to pay a double price. In any case, illegal fishing will have to pay a lot of money.

Who can catch with nets

Fishing with the help of nets can only be carried out by people who have issued a license for this type of activity. Usually these are fishing enterprises. Owner data is applied to their networks, and the organization itself receives a quota.

At the same time, a ban has been introduced on drift-net fishing, and violators may face a fine amounting to a year and a half of income. The final amount of penalties depends on many factors and sometimes exceeds 300 thousand rubles. Payment of the fine is carried out through a banking organization. To avoid such significant expenses, you should not fish with nets without an appropriate license.

How to get a license

To be able to fish with nets, you need to issue a personal permit. Such a document is issued for a fee on a special form. Moreover, you need to pay for the license itself and for catching a specific fish species.

  1. Typically, such permits are issued by divisions of the Federal Agency for Fishery, they give a license for fishing in public places.
  2. You can get the necessary paper in private offices that own water resources. They provide a fishing area at their water feature.
  3. Nominal permission has the strictest accountability. Such a document is issued to a specific citizen and cannot be transferred to third parties. It is even spelled out in the resolution itself.
  4. Such documents are issued to amateur fishermen who fish for the sake of interest, and not for the sale of caught biological resources. Fishing enterprises are already issued another license, which involves catching bioresources on an industrial scale for the purpose of their further sale.

If you violate the ban on the network, you can get an impressive fine or arrest up to 6 months. But such measures are applied if the catch is especially large or when fishing in prohibited areas. If you want to get only pleasure from fishing, and not serious financial losses, then it is better not to take risks and use only permitted gear in places where this is allowed by law.
