Changes in the Rules of recreational fishing in the Astrakhan region have come into force. On May 20, the Ministry of Justice of Russia registered the Order of the Ministry of Agriculture of the Russian Federation of April 19, 2016 No. 153, which amended paragraph 30.14 of the Rules for Fishing of the Volga-Caspian Fisheries Basin (Order of the Ministry of Agriculture of the Russian Federation No. 453 of November 18, 2014) (hereinafter referred to as the Rules) . This Order introduced changes, of course, not only in relation to fishing in the Astrakhan region, but in the publication I will focus only on this.




Changes have been made to a number of provisions of the Fishing Rules relating to recreational fishing in this region.


So, in subparagraph 30.14.1, the mention of the possibility of fishing at the “Volga Forbidden Pre-estuary Space” was removed.


According to Article 17 of the Federal Law of December 20, 2004 No. 166-FZ “On Fishing and Conservation of Aquatic Biological Resources” (as amended), “water bodies of fishery significance include water bodies that are used or can be used for the extraction (catch) of aquatic biological resources” (paragraph 3), and “categories of water bodies of fishery importance and features of the extraction (catch) of aquatic biological resources living in them are established federal body executive authority in the field of fisheries” (point 4).


The rules for water bodies of fishery importance in the Astrakhan region, where amateur fishing is prohibited, included:


– Volga forbidden pre-estuarial space;


- spawning grounds (Appendix No. 3 of the Rules);


wintering pits(Appendix No. 5 of the Rules).


The Volga forbidden pre-estuary space is defined in Appendix No. 2 and in a) subparagraph 21.1.1.1 of the Rules. Relevant maps of the area are available online.


For the attention of readers. The Volga pre-estuary forbidden space is limited by straight lines passing through the following nodal points:

The long-awaited changes have also been made to subparagraph 30.14.2 of the Rules. It was indicated here that the prohibited periods (periods) for the extraction (catch) of aquatic biological resources now begin not from April 20, but from May 16 and last until June 20. The rules, which in this part will come into force next year, establish that the spawning ban will be valid from May 16 to June 20.


At this time, it is forbidden to extract (catch) aquatic biological resources everywhere, with the exception of water bodies of fishery significance within the administrative boundaries of settlements, as well as in fishing areas provided for the organization of recreational and sport fishing during this period.


And the last. Nor have the catch rates been introduced into the Rules, which was discussed a lot, linking this with changes or the abolition of the spawning ban. Let me remind you that the terms of the ban, which are in force this year, were introduced with the advent of the new Federal Law of December 20, 2004 No. 166-FZ “On Fishing and the Conservation of Aquatic Biological Resources”. According to him, the reservoirs in the regions were divided into sections, which were leased.


There was a situation when during the spawning ban it was possible to fish only at those bases that had such plots or rented them. But not everyone rented RPU, and therefore, according to the above law, a number of camp sites cannot receive fishermen after the start of the ban, and those who have it can organize such fishing.


At the same time, as reported by regional media and fishermen's forums on the Internet, often such fishing for clients of such bases was without observing any catch standards. You can still find information about this on the Internet, sometimes on the relevant websites of business organizations.


Now the owners fishing bases they are lobbying for the RPU to be left in the draft Federal Law on amateur fishing, which takes a suspiciously long time to be finalized after passing the first reading.


The daily catch rates in the Fishing Rules, adopted after the entry into force of the named Federal Law, were canceled. Our readers probably remember that they were five kilograms per fisherman per day. But many understand that the decrease in fish in the Astrakhan region was not due to amateur fishing.


The fact that the ban begins in 2017 on May 16, when most of the fish have already spawned, with the exception of herring, of course, will not lead to further impoverishment of fish stocks in this region. As before, amateurs from mid-May and in June, in permitted places, will continue to fish predatory fish- zander, pike and perch that spawn earlier than white fish. Then they will start catching catfish and asps. Peaceful fish are caught almost everywhere.

I. General provisions

1. Fishing rules for the Volga-Caspian fishery basin (hereinafter referred to as the Fishing Rules) regulate the activities of Russian legal entities, individual entrepreneurs and citizens engaged in fishing in the Caspian Sea and inland waters Russian Federation within the areas specified in paragraph 2 of the Fishing Rules, as well as foreign legal entities and citizens engaged in fishing in accordance with the legislation of the Russian Federation and international treaties of the Russian Federation (hereinafter referred to as users).

2. The Volga-Caspian fishery basin is subdivided into the Northern and Southern fishery regions, delimited from each other by a conditional line running along the dam of the Volzhskaya hydroelectric power station (Volgograd city), with the exception of ponds and flooded quarries owned by the constituent entities of the Russian Federation, municipal and private property.

2.1. The southern fishery region of the Volga-Caspian fishery basin includes the Caspian Sea, as well as water bodies of fishery importance in the territories of the Astrakhan region, the Republic of Dagestan, the Republic of Kalmykia (coast

  • Caspian Sea in the territory of the Lagansk region, the Volga River in the territory of the Yustinsky region and Sarpinsky lakes) and parts Volgograd region(the Volga river with channels, volozhkas, branches and other water bodies of fishery importance below the dam of the Volga hydroelectric power station, the reservoir of the Volga-Don shipping canal with flowing rivers).

  • The Volga-Caspian fishery basin is specified in Appendix No. 1 to the Fishery Rules "Description and scheme of fishery sub-areas of the Southern fishery region of the Volga-Caspian fishery basin."

2.2. The northern fishery region of the Volga-Caspian fishery basin includes the Volga River from its upper reaches to the dam of the Volzhskaya hydroelectric power station (Volgograd city) with the basins of the rivers flowing into it, including reservoirs: Verkhnevolzhskoye, Ivankovskoye, Uglichskoye, Rybinskoye, Gorky, Cheboksarskoye, Cherepetskoye, Votkinskoye , Kamskoye, Nizhne-Kamskoye, Kuibyshevskoye, Surskoye, Saratovskoye, Volgogradskoye, as well as all water bodies of fishery significance located on the territories of the republics of Bashkortostan, Ingushetia, Kabardino-Balkaria, Mari El, Mordovia, North Ossetia - Alania, Tatarstan, Udmurtia, Chechnya , Chuvashia; Perm Territory, Belgorod, Bryansk, Vladimir, Volgograd (above the dam of the Volga hydroelectric power station), Vologda (Rybinsk reservoir and other water bodies of fishery significance in the Cherepovets region), Ivanovskaya, Kaluga, Kirov, Kostroma, Kursk, Moscow, Nizhny Novgorod, Orenburg, Oryol, Penza , Ryazan, Samara, Saratov, Smolensk, Tambov, Tver, Tula (Oka river basin), Ulyanovsk, Yaroslavl regions and the city of Moscow.

3. Fishing rules regulate the extraction (catch) of aquatic biological resources for the purpose of industrial fishing, including coastal fishing, fishing for research and control purposes, fishing for educational and cultural purposes, fishing for fish farming, reproduction and acclimatization of aquatic bioresources, recreational and sport fishing.

4. Fishing rules establish:

4.1. types of permitted fishing;
4.2. standards, including standards for the yield of products of processing of aquatic biological resources, including caviar, as well as the parameters and terms of permitted fishing;
4.3. restrictions on fishing and other activities related to the use of aquatic biological resources classified as objects of fishing, including:

  • prohibition of fishing in certain areas and in relation to certain types of aquatic biological resources;
  • the minimum size of harvested (caught) aquatic biological resources;
  • types of prohibited tools and methods of extraction (catching) of aquatic biological resources;
  • mesh size of fishing gear, size and design of gear for harvesting (catching) aquatic biological resources;
  • admissible by-catch of some species when harvesting (catching) other types of aquatic biological resources;
  • periods of fishing in water bodies of fishery importance;
  • other restrictions established in accordance with federal laws.

4.4. requirements for the conservation of aquatic biological resources classified as objects of fishing, including the obligations of users engaged in the extraction (catch) of aquatic biological resources, a list of documents required by users for fishing, requirements for users engaged in the extraction (catch) of aquatic biological resources.

5. When fishing for research and control, educational purposes, as well as for the purposes of fish farming, reproduction and acclimatization of aquatic biological resources, areas of harvesting (catch) prohibited for harvesting (catch) of aquatic biological resources, terms (periods) of harvest (catch), tools and methods of production (catch), species, sex and size composition of catches are not established by the Fishing Rules. Fishing gear and methods, areas and terms of extraction (catch) of aquatic biological resources, species, sex and size composition of catches for these purposes are established by scientific programs, work plans for the extraction (catch) of aquatic biological resources for educational purposes, as well as programs of work on artificial reproduction and acclimatization of aquatic biological resources, approved in the prescribed manner.

6. If international treaties of the Russian Federation in the field of fishery and conservation of aquatic biological resources establish rules other than the Rules of Fisheries, the rules of these international treaties shall apply.

7. In order to preserve the rare and endangered species of aquatic biological resources listed in the Red Book of the Russian Federation and/or the Red Book of a constituent entity of the Russian Federation, the extraction (catching) of such species of aquatic biological resources is prohibited.

8. In exceptional cases, the extraction (catch) of rare and endangered species of aquatic biological resources is allowed on the basis of permits for the extraction (catch) of aquatic biological resources in the manner prescribed by the Government of the Russian Federation (Federal Law of December 20, 2004 N 166-FZ " On Fisheries and Conservation of Aquatic Biological Resources”, Article 27 (Collected Legislation of the Russian Federation, 2004, N 52 (Part 1), Article 5270; 2006, N 1, Article 10; N 23, Article 2380; N 52 ( part 1), article 5498; 2007, N 1 (part 1), article 23; N 17, article 1933; N 50, article 6246; 2008, N 49, article 5748)).

II. Requirements for the conservation of aquatic biological resources classified as objects of fishing

9. The right to harvest (catch) aquatic biological resources arises on the basis of agreements and decisions established by the Federal Law of December 20, 2004 N 166-FZ "On Fishing and Conservation of Aquatic Biological Resources" (Federal Law of December 20, 2004 N 166 -FZ "On fishing and conservation of aquatic biological resources", Chapter 3.1)).

10. When carrying out the types of fishing specified in paragraph 3 of the Fishing Rules (with the exception of recreational and sport fishing), users: (see full document)

11. Vessel captain or person responsible for harvesting (catch) of aquatic biological resources in the course of harvesting (catch) of aquatic biological resources in the Caspian Sea: (see full document)

12. For recreational and sport fishing:

12.1 in ponds and/or flooded quarries owned by citizens or legal entities - citizens must obtain the consent of the owners of these water bodies of fishery significance;

12.2. conducting sports events in the field of fishing is carried out in compliance with the Fishing Rules;

12.3. on fishing grounds:

a) not provided for the organization of amateur and sport fishing - citizens need to obtain the consent of the user of the fishing area;

b) provided for the organization of amateur and sport fishing - citizens need to conclude an agreement on the provision of services with a user who has an agreement on the provision of a fishing site for the organization of the specified type of fishing (hereinafter referred to as a voucher for the extraction (catch) of aquatic biological resources). The voucher for harvesting (catch) of aquatic biological resources must indicate the volume of aquatic biological resources agreed for harvesting (catch) and the place of harvest (catch) within the fishing area, its validity period, and other information.

13. When organizing amateur and sport fishing on the basis of an agreement on the provision of a fishing site for the extraction (catch) of aquatic biological resources, users:

  • issue vouchers to citizens for the extraction (catch) of aquatic biological resources within the established quotas for the specified fishing area;
  • provide separate accounting by types, volumes and places of extraction (catch) of aquatic biological resources in the fishing log;
  • submit to the territorial bodies of the Federal Agency for Fishery information on the extraction (catch) of aquatic biological resources by areas of extraction (catch) no later than the 18th and 3rd day of each month as of the 15th and last day of the month.

15. Citizens in the implementation of recreational and sport fishing in the fishing areas provided for these purposes must have with them:

  • permit for extraction (catch) of aquatic biological resources;
  • passport or other identity document.

16. Users of aquatic biological resources are not entitled to:

16.1. to harvest (catch) aquatic biological resources:

  • without a permit for extraction (catch) of aquatic biological resources and without an allocated quota for extraction (catch) of aquatic biological resources, unless otherwise provided by the legislation of the Russian Federation;
  • in excess of the volumes of production (catch) quotas allocated to them by areas of production (catch), types of aquatic biological resources and volumes of permitted by-catch;
  • from ships and other watercraft that are not duly registered and do not have identification marks of the established form clearly marked on board;
  • with the use of piercing fishing gear, with the exception of amateur and sport fishing carried out with the use of special pistols and guns (hereinafter - spearfishing);
  • with the use of firearms (except for the extraction (catch) of seals), pneumatic weapons, as well as explosive, toxic, narcotic drugs, electric current and other fishing gear prohibited by the legislation of the Russian Federation;
  • rutting, by the method of bugling, jamming, with the help of rattling and botany;
  • by stopping the access of oxygen to a water body of fishery significance by destroying its water supply sources, and also not entitled to release water bodies of fishery significance for the purpose of extracting (catching) aquatic biological resources;
  • at dams, bridges, locks and other hydraulic structures at a distance of less than 0.5 km, at discharge collectors within a radius of less than 0.5 km, in spillways of power plants (except for the extraction (catch) of aquatic biological resources for research and control purposes) ;
  • within prohibited periods and in areas (places) closed for extraction (catching) of aquatic biological resources;
  • without the consent of users of fishing areas in the implementation of recreational and sport fishing in these areas;
  • at fish hatcheries, their workshops and points, cages for growing and keeping fish - at a distance of less than 0.5 km;
  • on reservoirs and streams of spawning and rearing farms, with the exception of fishing for the purposes of fish farming, reproduction and acclimatization of aquatic biological resources;
  • during periods of release of juvenile fish by fish hatcheries and from the end of these periods within 15 days in water bodies of fishery significance at a distance of less than 0.5 km in all directions from the release sites, with the exception of catching predatory and low-value fish species in order to prevent the grazing of juveniles of valuable fish species;

16.2. accept (deliver), have on board a vessel or a fishing area catches of aquatic biological resources (or products from them) of one species under the name of another species or without specifying the species composition; accept (deliver) catches without weighing and/or piece counting;

16.3. keep records and provide information on the extraction (catch) of aquatic biological resources with a distortion of the actual size of the catch, its species composition, used fishing gear, timing, types of use and methods of extraction (catch), as well as without indicating or indicating the wrong name of the area of ​​production (catch) );

16.4. have on board ships and other Vehicle, on fishing grounds located in areas (places) of extraction (catch) of aquatic biological resources, as well as in places of processing of raw materials, aquatic biological resources (including their fragments (parts) and / or products from them), not taken into account in the fishing log, technological magazine, acceptance documents (receipt, bill of lading);

16.5. to have on the deck of the vessel, fishing areas and in the places of production (catch) of aquatic biological resources (when fishing outside the fishing areas) in working condition fishing gear, the use of which in the given area and in the given period of time is prohibited;

16.6. to carry out spearfishing during the spawning period, in places of mass and organized recreation of citizens, as well as to use spearfishing equipment from the shore, from the board of floating facilities and wading; carry out spearfishing using scuba gear and other self-contained breathing apparatus;

16.7. install:

  • fishing gear with an overlap of more than 2/3 of the width of the channel of the watercourse and the reservoir, and the free part should fall on the deepest part of the channel (simultaneous sighting of seines from opposite banks “to the castle” is also prohibited);
  • fixed fishing gear in a checkerboard pattern;

16.8. use:

16.9. throw away or release the extracted (caught) aquatic biological resources specified in the permit for the extraction (catch) of aquatic biological resources, with the exception of recreational and sport fishing carried out on the “catch-and-release” principle, as well as fishing for the purposes of fish farming, reproduction and acclimatization of aquatic biological resources, if the extracted (caught) water resources do not correspond in their biological characteristics to the purposes of this type of fishing.

In the case of harvesting (catch) of prohibited species of aquatic biological resources, as well as species not named in the permit for harvesting (catch) of aquatic biological resources, for which the total allowable catch (hereinafter - TAC) is established, they (including the permitted by-catch) must, with the least damage, regardless of their condition, be released into their natural habitat.

In this case, the user is obliged in cases of harvesting (catching) prohibited species of aquatic biological resources, or exceeding the permitted by-catch of aquatic biological resources not specified in the permit, for which the TAC is established:

  • change the fishing position (the route of the next trawl or the position of the next sighting, setting of fishing gear should be at least 0.5 nautical miles (for marine areas) and at least 0.5 km (in inland waters, except for inland sea waters) from any point of the previous trawling, sighting or setting;
  • stop the extraction (catch) of aquatic biological resources in this area or in this fishing area and remove fishing gear, or put them in a non-working state. The resumption of production (catch) of aquatic biological resources at a given location is possible only on the basis of the permission of the authority that issued the permit for the extraction (catch) of aquatic biological resources;
  • reflect their actions in the ship's documents and the fishing log and send this information to the territorial bodies of the Federal Agency for Fisheries;

16.10. use fishing gear that has a size and equipment, as well as a mesh size (pitch) that does not meet the requirements of the Fishing Rules;

16.11. to harvest (catch) aquatic biological resources in poorly explored and temporarily non-commercial areas, with the exception of fishing in research and control areas, fishing for the purposes of fish farming, reproduction and acclimatization of aquatic biological resources;

16.12. to harvest (catch) acclimatized species of aquatic biological resources until the establishment of their TAC, with the exception of fishing for research and control, as well as educational purposes. These aquatic biological resources that have fallen into fishing gear should be immediately released into their natural habitat with the least damage, and the fact of their capture should be recorded in the fishing log;

16.13. allow fixed nets to be in the water (stagnation of nets) for more than 24 hours from April 16 to October 14 and 96 hours from October 15 to April 15, counting from the moment of their complete installation until the moment of their bulkheading or hauling on board the ship;

16.14. move along the channels of spawning rivers, lakes, reservoirs and their channels on all types of small-sized motorized watercraft during the spawning season of fish, with the exception of the use of motorized watercraft for fishing under permits for the extraction (catch) of aquatic biological resources;

16.15. allow the deterioration of the natural habitat of aquatic biological resources.

III. Industrial fishing, including coastal fishing, fishing for cultural and educational purposes in the Southern fishery region of the Volga-Caspian fishery basin

IV. Industrial fishing, including coastal fishing, fishing for cultural and educational purposes in the Northern fishery region of the Volga-Caspian fishery basin

25. Types of forbidden tools and methods of extraction (catching) of aquatic biological resources.

26. The minimum size of harvested (caught) aquatic biological resources (commercial size).

27. By-catch of juveniles (or individuals of non-commercial size) of aquatic biological resources.

28. By-catch of some species when harvesting (catching) other types of aquatic biological resources.

V. Recreational and sport fishing

29. Types of forbidden tools and methods of extraction (catching) of aquatic biological resources in all water bodies of fishery significance of the Volga-Caspian fishery basin.

In amateur and sport fishing it is prohibited:

a) application:

  • networks of all types;
  • traps of all types and designs (merezh, venter, tops, "muzzles", "stabs", etc.), with the exception of crayfish;
  • passive fishing gear (“zakidushki”, “staves”, “pokes” and others) on the rivers that are the habitat of salmon species of fish;
  • pneumatic weapons (with the exception of spearguns and pistols for spearfishing);
  • fishing rods and spinning gear of all systems and names with a total number of hooks (hooks) of more than 10 pieces per citizen;
  • trawling fishing gear;
  • net screening and binding fishing gear and devices (trads, nets, drags, bastings, lifting nets, circles, “TVs”, “screens”, “grip”, “drills”, “shards”, “capes”, “kerchiefs”, "Sakovs", "Kottsov", "lionfish", "Germans", "takers", "rezhakovs", "ohanovs" and others);
  • lifts ("spiders") and scoops larger than 100x100 cm, and with a mesh size (step) of more than 10 mm;
  • piercing fishing gear (jaws and others), with the exception of spearguns and pistols for spearfishing;
  • somovnikov;
  • traps;
  • hook tackle;

b) to harvest (catch) aquatic biological resources:

  • bagreniye method (for cutting);
  • silencing method;
  • lanyards with a total number of hooks of more than 10 pieces on fishing gear for one citizen;
  • for lighting;
  • on the track (trolling) using a sail and a motor using more than two lures;
  • circles and vents with a total number of hooks more than 10 pieces on fishing gear for one citizen;
  • with the help of the device of zaezdki, fences, barrettes, dams and other types of barriers partially or completely blocking the channel of reservoirs and watercourses and preventing the free movement of fish;
  • more than three crabs for one citizen, with a diameter of each cradle more than 80 cm and with a mesh size (step) of less than 22 mm; way to "smoke";
  • gill method (when using "cake traps", "harvesters");
  • crayfish wade by hand or by diving;

c) descent of reservoirs for the purpose of catching aquatic biological resources;

d) installation of huts and other fixed structures on the ice of water objects of fishery significance, with the exception of portable wind protection devices.

30. Places prohibited for extraction (catching) of aquatic biological resources, terms (periods) of extraction (catch) of aquatic biological resources, types of aquatic biological resources, minimum size of harvested (caught) aquatic biological resources (allowable size).

30.14. Water objects of fishery importance of the Astrakhan region.

  • the Volga forbidden pre-estuary space, with the exception of fishing areas provided for the organization of recreational and sport fishing;
  • spawning grounds specified in Annex No. 3 to the Fishing Rules "List of spawning grounds for sturgeon species of fish in the Volga riverbed";
  • wintering pits specified in Appendix No. 4 to the Fishing Rules "List of wintering pits located on water bodies of fishery significance of the Volga-Caspian fishery basin".
  • from April 20 to June 20 - everywhere, with the exception of water bodies of fishery significance within the administrative boundaries of settlements, as well as in fishing areas provided for the organization of recreational and sport fishing during this period;

30.14.4. It is prohibited to use tools and methods of extraction (catching) of aquatic biological resources, except for the following:

  • float rod consisting of a rod, fishing line, float, sinker, leash and hooks;
  • bottom rod(donk), consisting of a rod or whip, fishing line, sinker, leash and hook;
  • bottom fishing rod with shock absorber;
  • crayfish, in the amount of not more than three pieces per citizen;

Spinning tackle (spinning) consists of a rod with access rings and a handle on which a removable reel of fishing line is attached and is equipped with one bait with one double or tee anchor hook. Additionally, a sinker without hooks and anchor hooks can be placed in front of the lure.

Anchor hooks are used only when fishing on spinning rods and vents. The number of used hooks and anchor hooks should be no more than five pieces on fishing gear for one citizen, the size - no more than N 12 according to the Russian classification.

FISHERIES OF THE VOLGA-CASPIAN FISHING BASIN

(in abbreviations: for recreational fishing in the Astrakhan region)

I. General provisions

1. Fishing rules for the Volga-Caspian fishery basin (hereinafter referred to as the Fishing Rules) regulate the activities of Russian legal entities, individual entrepreneurs and citizens engaged in fishing in the Caspian Sea and inland waters of the Russian Federation within the areas specified in paragraph 2 of the Fishing Rules, and also foreign legal entities and citizens engaged in fishing in accordance with the legislation of the Russian Federation and international treaties of the Russian Federation.

4. Fishing rules establish:

4.1. types of permitted fishing;

4.2. standards, including standards for the yield of products of processing of aquatic biological resources, including caviar, as well as the parameters and terms of permitted fishing;

4.3. restrictions on fishing and other activities related to the use of aquatic biological resources, including:

  • prohibition of fishing in certain areas and in relation to certain types of aquatic biological resources;
  • closure of fishing in certain areas and in relation to certain types of aquatic biological resources;
  • the minimum size and weight of harvested (caught) aquatic biological resources;
  • types and number of allowed tools and methods of extraction (catching) of aquatic biological resources;
  • the size of the mesh of tools for the extraction (catch) of aquatic biological resources, the size and design of the tools for the extraction (catch) of aquatic biological resources;
  • distribution of harvesting (catch) areas for aquatic biological resources (area, sub-area, fishing zone, fishing subzone) between groups of vessels differing in the tools for harvesting (catch) aquatic biological resources, types and sizes;
  • periods of extraction (catch) of aquatic biological resources for groups of vessels differing in the means of extraction (catch) of aquatic biological resources, types (capacity) and sizes;
  • permitted by-catch of some species when harvesting (catching) other types of aquatic biological resources;
  • periods of fishing in water bodies of fishery importance;

7. In order to preserve the rare and endangered species of aquatic biological resources listed in the Red Book of the Russian Federation and/or the Red Book of a constituent entity of the Russian Federation, the extraction (catching) of such species of aquatic biological resources is prohibited.

II. Requirements for the conservation of aquatic biological resources

10. For recreational and sport fishing:

10.1. citizens have the right to carry out recreational and sport fishing on water bodies of fishery significance common use freely and free of charge in accordance with the Fishing Rules;

15. When fishing, it is prohibited:

15.2. citizens to harvest (catch) aquatic biological resources:

  • with the use of piercing tools for production (catch), with the exception of amateur and sport fishing, carried out using special pistols and guns for spearfishing (hereinafter referred to as spearfishing), pneumatic weapons, firearms(with the exception of the harvesting (catch) of marine mammals), tools and methods of harvesting (catch) that affect aquatic biological resources electric shock, as well as explosive, toxic, narcotic drugs (substances), self-catching hook gear and other tools and methods of extraction (catching) prohibited by the legislation of the Russian Federation;
  • ways of bugling, jamming, rutting, including with the help of rattling and botany;
  • on wintering pits;
  • in forbidden and closed areas of production (catch) and in the periods (periods) prohibited for production (catch);

15.4. ... citizens are prohibited from:

15.4.1. throw away (destroy) or release harvested (caught) aquatic biological resources permitted for harvesting (catch), except for:

amateur and sport fishing, carried out on the principle of "caught and released";

15.4.5. use small size and pleasure craft during the prohibited period on water objects of fishery significance (or their sections) specified in Appendix No. 5 to the Fishing Rules "List of spawning sites located on water objects of fishery significance of the Volga-Caspian fishery basin", with the exception of non-self-propelled vessels, as well as other vessels used to carry out permitted activities for the extraction (catching) of aquatic biological resources;

16. Citizens are prohibited from:

16.1. carry out spearfishing:

  • in areas prohibited and closed for fishing, in periods (periods) prohibited for harvesting (catching) aquatic biological resources;
  • in places of mass and organized recreation of citizens;
  • using scuba gear and other self-contained breathing apparatus;

16.2. use special pistols and spearguns for spearfishing:

  • from the shore
  • from the board of floating facilities and wading;

16.3. to have on board the ship and floating craft, in fishing areas and in places of production (catch) (when fishing outside fishing areas) equipment for production (catch), the use of which in this area and in a given period of time is prohibited, as well as aquatic biological resources, production (catch) of which in a given area and in a given period of time is prohibited or part of them;

16.4. exceed the volume and quantity of harvested (caught) aquatic biological resources specified in the voucher.

In amateur and sport fishing it is prohibited:

e) the use of tools and methods for the extraction (catching) of aquatic biological resources in water bodies of fishery significance of the Astrakhan Region, with the exception of the following:

  • float fishing rod, consisting of a rod (including with throughput rings and with a removable spool of fishing line), fishing line, float, weights, leashes and hooks;
  • a bottom fishing rod (donk), consisting of a rod (including with throughput rings and a removable reel with fishing line or cord) or a whip, fishing line or cord, sinker, leashes and hooks;
  • bottom fishing rod, consisting of a rod (including with throughput rings and a removable reel with fishing line and cord) or a whip, fishing line, sinker, feeder or bagasse with no more than 2 hooks;
  • bottom fishing rod with shock absorber;
  • spinners, wobblers, flies and other baits, different in shape and color with hooks (single, doubles or tees);
  • crayfish, in the amount of no more than three pieces per citizen, each of the parameters of permitted crayfish (length, width, height - for polygonal, height, diameter - for conical and cylindrical) should not exceed 80 cm;
  • production (catch) per lane using a rowing vessel or floating craft using no more than two lures per vessel or floating craft;
  • production (catch) for trolling - using a sail and / or a motor using no more than two lures per vessel or floating craft;
  • production (catch) of fish "on kwok";
  • boats;
  • girders;
  • special spearguns and pistols for spearfishing;

30. Areas prohibited for extraction (catch) of aquatic biological resources, terms (periods) of extraction (catch) of aquatic biological resources, types of aquatic biological resources, minimum size of harvested (caught) aquatic biological resources (commercial size):

30.14. Water objects of fishery significance of the Astrakhan region:

  • the Volga forbidden pre-estuary space, with the exception of fishing areas provided for the organization of recreational and sport fishing;
  • spawning grounds specified in Appendix No. 3 to the Fishing Rules "List of spawning grounds for sturgeon species of fish in the Volga riverbed";
  • wintering pits specified in Appendix No. 5 to the Fishing Rules "List of wintering pits located on water bodies of fishery significance of the Volga-Caspian fishery basin".
  • from April 20 to June 20 - everywhere, with the exception of water bodies of fishery significance within the administrative boundaries of settlements, as well as in fishing areas provided for the organization of recreational and sport fishing during this period;
  • from April 1 to June 30 - crayfish.

The commercial size of aquatic biological resources is determined in fresh form:

  • in fish - by measuring the length from the top of the snout (with the mouth closed) to the base of the middle rays of the caudal fin;
  • in crustaceans, by measuring the body from the line connecting the middle of the eyes to the end of the tail plates.

Produced (caught) aquatic biological resources, having a length less than indicated in Table 16, are subject to immediate release into the natural habitat with the least damage.

VI. Responsibility for violation of the Fishing Rules

31. Legal entities, individual entrepreneurs and citizens engaged in the extraction (catch) of aquatic biological resources guilty of violating the Fishing Rules shall be liable in accordance with the legislation of the Russian Federation.

10. For recreational and sport fishing:

10.1. Citizens have the right to carry out amateur and sport fishing in public water bodies freely and free of charge. Citizens are prohibited from harvesting (catching) within the boundaries of fish farms without the consent of fish farms - users of fish farms;

10.2. V. Recreational and sport fishing

29.1. For amateur and sport fishing in the Astrakhan regionthe use of all weapons is prohibitedand methods of extraction (catch), except for the following:

Citizens have the right to carry out amateur and sport fishing in public water bodies of the Astrakhan region free and free in compliance with the Fishing Rules for the Volga-Caspian fishery basin, approved by Order of the Ministry of Agriculture of the Russian Federation dated November 18, 2014 No. 453.

The total daily rate of production (catch) for all types of aquatic biological resources (except for freshwater catfish), including those not listed in the table, is not more than 10 kg or one specimen if its weight exceeds 10 kg.

If the total daily norm is exceeded, the extraction (catch) of aquatic biological resources is terminated.

ATTENTION! Citizens guilty of violating the Fishing Rules are liable in accordance with the legislation of the Russian Federation.

When attracted to administrative responsibility for violation of the rules governing fishing, citizens may be fined in the amount of two thousand to five thousand rubles with or without confiscation of the vessel and other tools for the extraction (catch) of aquatic biological resources (Part 2 of Article 8.37 of the Code of Administrative Offenses of the Russian Federation).

For illegal extraction of aquatic biological resources, criminal liability, provided for by Article 256 of the Criminal Code of the Russian Federation, if this act is committed:

b) using a self-propelled floating vehicle or explosive and chemical substances, electric current or other prohibited weapons and methods of mass extermination of aquatic biological resources;

(a) causing major damage;

b) with the use of a self-propelled floating vehicle or explosive and chemical substances, electric current or other methods of mass extermination of these aquatic animals and plants;

c) in spawning areas or on migratory routes to them;

d) in specially protected natural areas or in the zone of ecological disaster or in the zone of ecological emergency.

For this crime, the convicted person shall be punished with a fine in the amount of three hundred thousand to five hundred thousand rubles, or in the amount of the salary or other income of the convicted person for a period of two to three years, or by corrective labor for a term of up to two years, or by deprivation of liberty for the same term.

Besides, the angler must remember that during fishing it is within the boundaries of the water protection zones of rivers, lakes, streams, canals (50-200 m from the coastline, depending on the length of the watercourse), where a special regime for economic and other activities is in place in order to prevent pollution, clogging, silting these water bodies and the depletion of their waters, as well as the preservation of the habitat of aquatic biological resources and other objects of the animal and plant world.

Within water protection zones prohibited movement and parking of vehicles (except for special vehicles), with the exception of their movement on the roads and parking on the roads and in specially equipped places with a hard surface.

Violation of this prohibition entails administrative liability in the form of a fine for citizens in the amount of three thousand to four thousand five hundred rubles (Part 1 of Article 8.42 of the Code of Administrative Offenses of the Russian Federation).

It is also prohibited to wash vehicles within the boundaries of fish protection zones of water bodies of fishery importance in the Astrakhan region (depending on the length of the water body, the width of the zone is from 50 to 200 meters from the water area).
